    Hello, Colin and Yen Yen,

    I have a question (actually a number of related qns) for you but must first apologise if I am misdirecting it to you - I’m kinda asking every source I think might be sympathetic - so please bear with me a little ;-)

    The general question is: Does a S’pore person serving NS (be it full time or reservist) have recourse to Civilian Law (and access to certain civil/human rights, what little we have in S’pore!) when in the S’pore Army?

    The matter at hand is this: The Commander of Khatib Camp has just ordered a batch of Reservists currently doing ICT to undergo compulsory HIV testing. No opting out. The fear obviously is that HIV positive people might not enjoy confidentiality, or be accorded proper recourse to counselling and treatment and whatever, instead they face some pretty frightening prospects….

    Hope you can help in some way.

    Hi, I don’t know if I’m in any position to answer this. Haven’t practiced law in nearly ten years. But off the top of my head, I don’t think being in the Army immediately deprives you of recourse to civil remedies. The compulsory HIV testing does sound intrusive, but as far as I can recall, Singapore doesn’t really recognise a right to privacy per se, so it could be problematic for you even in the civil courts. Have passed this message on to some others who might know more, and will post a response as soon as I hear back. Sorry I can’t be of more help. - Colin
